License Agreement

Licence agreement for patterns sold by Melanie Hoffman Designs from Adorabubbleknits.com and theknittingsiren.com
 
This agreement does not apply to patterns available for free from Adorabubble Knits/The Knitting Siren. However, patterns available for free from this site are protected by copyright law, just as much as the patterns available to purchase are protected. You must contact Melanie Hoffman to negotiate a licence if you wish to produce garments or items under commission or for sale.
 
By purchasing, downloading, installing, copying, printing, or otherwise accessing a pattern from AdorabubbleKnits/The knitting siren, you are agreeing to the terms below.
 
If you do not agree with the terms, then either (a) don't buy the pattern; or (b) if you have already made the purchase, do not download the pattern (or delete it immediately) and e-mail to request a refund.
 
A. What do you get when you make a purchase?
 
1. You get a copy of the pattern in PDF format, which you can use in accordance with this licence agreement. This licence agreement allows you to do what you'd normally be legally allowed to do with a printed pattern you bought from a store, plus a little more.
 
2. Most of what you get under this licence agreement is attached to the pattern purchase. One particular entitlement, however, is attached to the original purchaser. Rights that follow the licence (and will follow the pattern if it is sold or given away in accordance with this agreement) include the right to make personal working copies and backup copies. However, the entitlement to receive e-mail support, described in section F, belongs to the original purchaser only.
 
B. Copyright
 
3. You agree that the pattern, whether in electronic, print, or any other format, the original garment or item, the original design, and the underlying artwork, are protected by copyright law and international copyright treaties, and furthermore that the copyright is owned by Melanie Hoffman. You also agree that you will not distribute, upload, or communicate the pattern in whole or in part, in any form whatsoever, except in accordance with this licence agreement.
 
C. What can you do under this licence agreement?
 
4. You can download a first copy of the pattern in PDF format (which may be compressed to speed up download time) from Adorabubble Knits/ The Knitting Siren.
 
5. You can knit as many garments or items as you like from the pattern, either for yourself or as gifts for others. If you want to sell the garments or items, see the additional terms in section D.
 
6. You can knit as many garments or items as you like for charity, provided that they are intended for direct charitable acts: as an example, if you are knitting hats, then the recipients of the hats must be the recipients of the charitable works. If the garments or items are intended to raise money for charity, see section D.
 
7. You can make a backup copy of the PDF file on any computer storage medium (e.g. hard drive, CD-R/RW, DVD-R/RW, memory key, or any other storage medium), to be used only if your first copy is erased, corrupted, or otherwise rendered unusable, and which you may keep as long as you have not given away or sold the pattern.
 
8. You can print out as many working copies of the pattern as you personally need, as long as they remain in your possession and as long as you have not given away or sold the pattern.
 
9. You can give the electronic pattern away once you're done with it to one person only, as long as you do not retain any copies for yourself, whether they are working copies or backup copies, in paper or electronic form. Any such copies must be deleted or destroyed when the electronic pattern leaves your possession. If you give the pattern away, then you have assigned your rights under this licence agreement to the recipient, and the recipient must agree to be bound by the terms of this licence agreement: see section E.
 
10. You can sell the pattern once you've done with it to one person only, as long as you do not retain any copies for yourself, whether they are working copies or backup copies, in paper or electronic form. Any such copies must be deleted or destroyed when the electronic pattern leaves your possession. If you sell the pattern, then you have assigned your rights under this licence agreement to the buyer, and the buyer must agree to be bound by the terms of this licence agreement, and this agreement must be in writing: see section E.
 
11. You can lend the pattern only by giving it away, as described in paragraph 9. That means your backup copies or working copies must either be deleted or destroyed when the pattern is lent out. In fact, the only difference between giving your pattern away, as in paragraph 9, and lending the pattern is that you're trusting you'll get the pattern back. Just as in paragraph 9, the person borrowing your pattern must agree to be bound by this licence agreement as well: see section E.
 
D. How many garments or items can you sell or make for commission, or use for charitable fundraising under this licence agreement?
 
12. You personally may make and sell up to two garments or items per licence, total, as long as you provide acknowledgement. For example, this means that if the pattern contains instructions for making a hat and coat, you may make one hat and one coat, or two hats and no coats, and sell them for however much you want, as long as you acknowledge that the items were designed by "Melanie Hoffman from Adorabubbleknits.com" either at the point of sale or on a label attached to the item. You must also e-mail me to tell me what you're doing, I like to know.
 
13. You may make up to two garments or items per licence, total, under commission or other compensation for your labour and materials as long as you provide acknowledgement. For example, this means that if the pattern contains instructions for making a hat and coat, you may make one hat and one coat, or two hats and no coats, and be compensated for however much you want, as long as you acknowledge that the items were designed by "Melanie Hoffman from Adorabubbleknits.com" either upon accepting the commission or delivery of the finished garment or item. Again, you must also e-mail me to tell me what you're doing, because I'm still quite curious.
 

14. For charitable fundraising, similarly you can make and sell up to two garments or items per licence, total, but acknowledgement at the point of sale or on a label is not necessary (it would be nice, though).

15. In either case (raising money for yourself or for charity), you can negotiate a licence for making more than two items. E-mail me for more details.
 
E. And what happens when I sell the pattern or give it away?
 
16. The licence attached to each pattern is transferable and assignable by you, as mentioned in paragraph 9. This means that you can sell the pattern, or give it away, to one person as long as you do not retain any copies for yourself, whether they are working copies or backup copies, in paper or electronic form. Any such copies must be deleted or destroyed when the electronic pattern leaves your possession.
 
17. When you sell the pattern or give it away, it must be intact in its original electronic format, which includes the notice on the last page that the pattern is protected by copyright and distributed under the terms of this agreement.
 
18. The right to make up to two garments or items per licence, as described in section D, is attached to the licence itself. It is not automatically renewed when the pattern changes hands. If you make and sell one hat from a hat pattern, for example, then sell the pattern, the buyer is not entitled to make and sell two hats; he or she is only entitled to make and sell one. When you transfer your rights in the pattern, if you have made and sold garments or items from the pattern, you must advise the recipient or buyer how many items are left for him or her to make and sell or use for fundraising.
 
19. The recipient or the buyer of the pattern agrees to be bound by the terms of this licence agreement; however, the recipient or the buyer will not be entitled to support for the pattern, as described in section F. Note that if you are purchasing the licence as a gift for someone else, we can carry out the transaction in a manner that entitles the gift recipient to support. E-mail for details before making a purchase.
 
20. You may not, under any circumstances, give or sell a copy of the pattern to more than one person. You may not purchase multiple licences for resale.
 
F. Personal support
 

21. I will make my best efforts to provide reasonable support for the purchaser of the pattern by e-mail only. See the support page for a discussion of "reasonable support". Support will only be provided to the e-mail address that is used to effect the purchase of the pattern. Do not expect to receive support via a different e-mail address unless you can convince me that you're the same person who bought the pattern.

22. This support is not available to a subsequent assignee or transferee of the pattern licence. That means that if you sell or give away the pattern, the person who receives or buys the pattern from you will not receive this support.
 
23. Adorabubble Knits/ TheKnittingSiren is not responsible for your skill level. If you do not possess the requisite abilities to knit a pattern, it is your responsibility to brush up your skills. The best I can do is point you towards a book or website that provides information about the techniques used, and no, I'm not going to lend you any of my books.
 
G. Other things that aren't my fault
 
24. Adorabubble Knits/ TheKnittingSiren is not liable for your computer hardware. These patterns are graphics intensive and may take some time to render to your screen or spool to your printer. If your computer can't handle the file size, I will make my best efforts to supply you with usable substitute electronic files, but I will not provide a print copy. Any replacement or substitute electronic files are provided pursuant to this licence agreement, and the terms of this agreement apply to those files.
 
25. Adorabubble Knits/ TheKnittingSiren is not liable for any software installed on your computer. It is your responsibility to make sure that any software required for displaying and printing the pattern (printer drivers, PDF readers, decompression programs, etc.) is installed on your system and that proper licences have been obtained for this software. For further information, you should contact the manufacturer of that software.
 
H. And a few other terms
 
26. The terms of the licence agreement published on Adorabubble Knits/ TheKnittingSiren website may be unilaterally revised from time to time by Melanie Hoffman; however, the licence agreement that was published to the website at the time of your purchase is the licence agreement that shall remain in force for your pattern. The terms of the licence agreement may also be revised by negotiation between you, the purchaser, and Melanie Hoffman. In that case, the amended licence agreement, as agreed to by the two of us, shall be the governing agreement between us.
 

27. Headings in this licence agreement do not form part of this licence agreement.
